Challenge
Accusations of attempted monopolization and price fixing made by federal regulators led to charges filed against our client by numerous state attorneys general and private attorneys.

The initial press coverage, before we were retained, highlighted the allegations and included only a boilerplate denial of any wrongdoing by the company.

Solution
Our client’s lawyers decided, among other things, to challenge the federal agency’s authority to bring the suit. The E&A team used this argument to put the agency on trial. Articles were written, op-eds placed, and conferences held that shifted the focus of the coverage away from the alleged actions of the company.

Result
By the time the court ruled against the company, the case was in discovery and the media had lost interest.
